Background of the assignment
UNODC developed the project: “Strengthening the role of law enforcement in China’s HIV response.” The main objective of the project is to strengthen law enforcement action to prevent the spread of HIV/AIDS in China by: (a) creating a coordinating body within the National Narcotics Control Commission; (b) institutionalizing HIV/AIDS prevention in the education institutions of the Ministry of Public Security and the Ministry of Justice; (c) capacity building, and; (d) offering HIV/AIDS prevention, care and support to those in confined settings. This project is a complex set of activities which all together should be able to bring fully on board law enforcement in the Country’s effort to step up the HIV response. Complexity also stems out from two additional considerations: (1) HIV and AIDS do per se require a multidisciplinary approach involving a wide range of expertise; (2) China, with 1,5 million people detained, and an accumulated number of drug users totaling 1,1 million, represents a wide and challenging working environment. On a daily basis the project will be brought forward by a team composed of one national program officer, assisted by an administrative staff, under the guidance of the Country Advisor HIV/AID.
Purpose of the assignment
In carrying out the propose tasks the international institution/consultant will work as part of a team comprised of a national consultant and UNODC staff. The international institution/consultant will conduct a desk review of relevant legislative provisions and regulations on HIV related to drug use and in closed settings, assess the situation in the settings and work with officials on practical arrangements to strengthen police response to HIV. To accomplish his/her tasks, the consultant will travel to Beijing two to three times to hold consultations with the project team, national and UN counterparts and civil society as relevant.
Specific tasks to be performed by the consultant
• (Desk review tasks) Review existing international good practices in HIV prevention, HIV voluntary counseling and testing (VCT), and HIV/AIDS treatment, care and support in closed settings;
• Review relevant national, provincial and local laws, regulations, policies and law enforcement practices relevant to HIV prevention in closed settings and make input to the national consultant’s report;
• Review law enforcement practices, policies and procedures on drug abuse and on HIV/AIDS applicable in closed settings and make input to the national consultant’s report;
(Field visit tasks)
• Analyze epidemiological data on HIV/AIDS and HIV-related risk behavior among residents in closed settings and assess risk behaviors;
• Review and report on risk reduction procedures and further needs in compulsory treatment and rehabilitation centers and in re-education through labor centers;
• Review and report on law enforcement practices, policies and procedures on drug abuse and on HIV/AIDS applicable in closed settings;
• Analyze the findings against relevant national, provincial and local laws, regulations, policies and law enforcement practices relevant to HIV prevention in closed settings and against relevant international best practices regarding HIV prevention in closed settings;
• Communicate with national counterparts about the findings and recommendations.
(Establishment of HIV Prevention Unit)
• Review NNCC existing arrangements to respond to HIV and make necessary recommendations for change in collaboration with the national consultant;
• Map and review on-going activities conducted by national and international agencies and organizations including the Ministry of Health (MOH) and explore scope for linkages and make necessary recommendations; Brief NNCC the recommendations and propose changes
• Prepare a module for 1 two-days HIV prevention training for the unit appointed staff and conduct the training with the national consultant to the appointed staff;
(Reporting tasks)
• Prepare and submit report summarizing the findings of the desk review and of the field visits with specific recommendations for improvement in line with good practices and appropriate to the Chinese context).
Expected tangible and measurable output(s)
• A comprehensive review of HIV laws and regulations and relevant drug laws in China accompanied by recommendations for improvement in line with international best practices and appropriate to the Chinese context;
• A comprehensive review of the HIV situation in closed settings accompanied by recommendations for improvement in line with international best practices and appropriate to the Chinese context;
• Recommendations for improving coordinating capacity by the NNCC of HIV prevention work related to drug use and in closed settings;
• A two-days training on HIV prevention is organized and implemented for NNCC relevant staff.
Indicators to evaluate the consultant’s performance
• The institution/consultant will provide to the HIV/AIDS Country Advisor short written progress reports every two weeks, a written report on the results of the desk review in 3 months time, a report on situation in closed settings one months after field visits have been completed, while the final overall written report covering all activities will be provided at the end of the assignment.
Competencies
- Experience in working with law enforcement agencies (Public Security, Justice Department) on HIV/AIDS control in China and in other countries.
- Extensive experience in desktop reviews of legislative and administrative provisions on HIV and AIDS, training of staff, drafting of curricula on HIV and AIDS, advocacy campaigns, report drafting;
- Proven track record of working in the area of harm reduction in confined settings;
- Experience with the UN system, particularly with UNAIDS co-sponsors;
- Experience in working with central government agencies in China;
- Excellent communication and writing skills.
Requirements of the proposal
A proposal is required to apply for the potential institutional contract. The proposal should include previous experience in relation to the TOR, how the service will be provided, schedule and planning, proposed cost of the service, individual consultants’ CV who will serve the project.
