Activities in Other Countries The Asia Law Initiative works in Afghanistan, Indonesia and Thailand. Other ABA programmes work in many countries of Central and Eastern Europe.
Established by just 100 American lawyers in 1878, the American Bar Association now has over 400,000 members and describes itself as ‘the world’s largest voluntary professional association’. It provides services for its members and serves as a voice for the legal profession on many matters of public interest, seeking to advance the rule of law and the administration of justice. The Association thus sees itself as an ‘advocate for the [legal] profession and for the public.’ It has initiated hundreds of special programmes addressing issues of public concern ranging from child abuse to environmental legislation.
The Association’s ‘Asia Law Initiative’ (ALI) was launched in 1998, to offer technical assistance to Asian countries engaged in reforming and developing their legal systems. The Initiative has been based on the principle that assistance should be given at the request of the countries concerned, addressing the priorities that those countries identify.
In China, the Initiative has cooperated with the Ministry of Justice in holding a comparative symposium on Legal Aid, followed by a training programmes for Chinese legal aid practitioners. ALI has also partnered with the All-China Lawyers Association in workshops on legal ethics and criminal defense law; and it has collaborated with the Shaanxi Judges Association and the Berlin Judges Association on a comparative exercise – a mock trial, before an invited audience of 400 legal professionals – to see how trial procedures for domestic violence cases differ in China, the US and Germany.
Since 2002, a major part of ALI’s work in China has been an ‘environmental governance’ programme, carried out in partnership with the State Environment Protection Agency. This has included a series of training workshops with stakeholders in regional cities to consider ways that law and the legal system can contribute to environmental protection. Follow up work with local partners has led to the development of some relevant, legal ‘tools’. For example, ALI helped the Environment Protection Bureau in Shenyang to draft a ‘Law on Access to Information and Public Participation.’
Funding for ALI’s work on environmental governance and legal aid in China has been provided by grants from the US State Department. Other ALI projects in China have received support from the Ford Foundation, The Asia Foundation, the U.S.-China Business Council and the US-China Legal Cooperation Council.
